The Failure of the 28-Clause Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the announcement of a new 28-article proposal for ending the war appeared – temporarily – to have been defused. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: a renewed assault of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The chain of conflicting incidents captured the bleak nature of the recent timeframe. By day, diplomatic battles are fought: positive announcements are delivered from different nations. Considerable effort is allocated on restraining certain initiatives. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the key method for achieving "settlement".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is capable of detecting projectile deployments from across the border, a capacity enabled by current data. From observation points, military aircraft that had been scrambled to counter approaching guided weapons flew past – sophisticated military planes supplied to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems thundered: several firings deployed against a hostile projectile. This was a sophisticated defense system at work, presumably provided by allied countries. Every deployment shakes the surroundings, causing tremors. The moment of terror quickly gives way to sober acceptance: possibly the incoming missile won't hit its mark this time, protecting urban areas from catastrophe and another blackout.

Persistent Threats

Not long after, a heavy machine gun fired at a drone somewhere nearby, part of a mobile-fire group – probably Western-made equipment. Sadly, the projectiles didn't strike the hostile drone – it maintained course toward its target.

Intermittently, this continued until dawn. Kyiv awoke to the morning news: multiple fatalities, destruction and heating outages in numerous residences as a result of the evening attack. As customarily, everyone still continued their routines – enduring hostilities. But those entire period encapsulated Ukraine's critical military reliance on external assistance – a dependence that regional partners are clearly incapable to replace in the immediate future.

Unsuccessful Negotiations

The 28-point plan from American leadership generated strong feelings, controversy and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and international summits.

Every new proposal from American administration unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This pattern will, certainly, endure.

Strategic Calculations

It is convenient to criticize certain parties of persistently promoting Russian terms. But that does not seem to be the entire situation. American leadership works based on a principle familiar among experienced diplomats: you cannot achieve through diplomacy what you have lost on the battlefield. The American government believes that it is unfeasible to pressure the Kremlin to abandon the territory that it currently occupies in Ukraine's south or east.

The problem is that while accepting these circumstances, Washington does little to discourage Russia, through diplomacy or military means, from assuming that the status quo will not change more in its advantage in the coming year.

Conflicting Perspectives

Therefore, Moscow is convinced that time is on his side – that Ukraine and its partners are nearing depletion. Their reason to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to stop fighting, but they will continue as long as Russia's government remains highly assured in the conclusion.

On the contrary, Kyiv believes that Ukraine can still persist, progressively conceding people and territory but averting a complete military breakdown until circumstances change in its benefit.

Current Realities

Objectively, there are no genuine requirements for a ceasefire. Now, subjective factors are entering the equation: political desires to negotiate peace and achieve global acclaim, and Ukrainian leadership's twin challenges – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any plan Kyiv finds unsuitable, so that their attention does not switch to domestic problems. And although their mission will now be much harder after latest incidents, it remains quite doubtful that this will alter their fundamental strategy.

These opposing factors are influencing discussions.

Assessment and Future

It took a mere seven days to terminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on old ideas are approaching, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and show particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, mainly require sustained allied backing.
